Nater Dallafior successfully represents a sports management company and a Formula 1 Driver against a Formula 1 motor racing team

A sports management company representing a Formula 1 Driver entered into a Driver Agreement with a Formula 1 motor racing team for a minimum period of two years. The team did not pay the agreed remuneration for the first year and appointed a new driver for the following period. The racing team refused payment on the basis of alleged misrepresentations, arguing that it would not have entered into the Driver Agreement but for the oral promises to bring investors. While in emergency proceedings under the Swiss Rules no specific performance was granted under the applicable English law, the Sole Arbitrator acting pursuant to the Swiss Rules fully upheld the payment claim and dismissed counter-claims of short of USD 20 million.
