New Publication on Enforcement of Awards Against States

Nater Dallafior senior associate Tobias Thaler and partner Nino Sievi have contributed to a commemorative volume dedicated to Prof. Marianne Roth, LL.M. (Harvard) on the occasion of her 65th birthday.

 They co-authored the article "Enforcement of Awards Against States in Switzerland – A Practitioner's Perspective".

 The article examines the practical challenges of enforcing arbitral awards against states in Switzerland. While Switzerland offers an arbitration-friendly legal framework and efficient enforcement procedures, the attachment and enforcement stages provide states with various procedural opportunities to challenge enforcement, particularly through immunity-related objections. As a result, the enforcement of arbitral awards against states often remains complex and demanding in practice. The authors identify several recurring obstacles that practitioners regularly encounter.
