New Publication on International Arbitration

Nater Dallafior Partner Mladen Stojiljković and Senior Associate Tobias Thaler co-authored an article titled "Swiss Federal Court Rejects Arbitrator Challenge Over Repeat Appointments" for LexisNexis.

 The article discusses a recent Swiss Federal Court decision (4A_575/2023 dated 18 April 2024) in which a party unsuccessfully challenged an arbitral award, alleging apparent bias of the sole arbitrator due to multiple appointments by the same law firm. The Swiss Federal Court clarified that procedural irregularities to which a party did not object are waived. The court noted that there was no appearance of bias in the present case and would have rejected the challenge on this ground as well.
